Rules & Regulations

1. CARPETNo carpet on dock stakes, RUBBER ONLY. Carpet may be placed on the dock surface, but only with the approval of Management and the adjacent dock renter.
2.CHARTERS This contract is null and void without a current "Chartering Agreement" with WINKE’S BOAT STORAGE, INC. & LANDING. Management reserves the right to limit the total number of charters in the Marina, and as such can refuse entering a "Charter Agreement" after acceptance of this contract. Chartering is defined as "…any commercial purpose…", not limited to "Fishing Charter(s)".
3.CLOTHESLINE No "permanent" clotheslines are allowed.
4. CONTRACTContracts are non-transferable, may not be sublet, and are in effect from May 1st through November 1st of the contract year. Early and/or late occupancy (prior to April 15th and after November 15th ) may result in additional charges/fees/rents above and beyond the amounts stated within the body of this contract. All boats must be out of the water by November 15th. Change in ownership of the noted vessel or a change of the vessel noted requires a new contract.
5.DAMAGE WINKE’S BOAT STORAGE, INC. & LANDING reserves the right to bill out for any damage to, or clean up of property, equipment, or the physical environment that are the result of a customer’s actions, and are not limited to but included: broken dock stakes, damaged electrical boxes, broken water fixture(s), fuel or oil spills, etc.
6.DOCK LOCATIONDock assignments are made by and subject to change at the discretion of Management in the best interest of everyone in the Marina.
7.DOGSAll dogs will be kept on leashes and it is the responsibility of the owner to insure that all stool deposits are cleaned up IMMEDIATELY. Failure to do so could result in loss of privileges. Management reserves the right to request the removal of any dog that is perceived as a nuisance or a danger.
8.FIRESNo fires, including charcoal broilers are permitted on boats or docks in the Marina area.
9. FUELINGNo fueling of vessels dockside will be permitted without complete and total permission of Management, and verification of all insurance and safeguards. If permission is granted, it will be on a case by case basis, with at least one (1) member of WINKE’S BOAT STORAGE, INC. & LANDING staff present and at cost to the party requesting the fueling. VIOLATION WILL BE CAUSE FOR IMMEDIATE EVICTION.
10.GOLF CARTS The use of GOLF CARTS in the Campground and Marina area is permitted. All standard vehicle operating rules apply. No person under the age of 16 is permitted in any fashion to operate a golf cart on the Marina property. All non-electric carts must have adequate and proper sound suppression. Violation of these rules may result in the immediate removal and potential banning of the golf cart from the facility until the problem/violation(s) is corrected or addressed. We request that use of non-electric golf carts during quiet time be kept to a minimum.
11. GUEST DOCKSManagement reserves the right to assign, as a guest dock, any dock that is not occupied. Management requests to be informed if your dock will be unoccupied for a prolonged length of time. Management also suggests the filing of a "float plan" with the Gas Dock in regards to voyages of extended periods.
12. GUEST Boat owners will be responsible for the conduct of their family and guests. To avoid embarrassment, Management suggests notifying the main office and/or the Gas Dock in advanced when guests are to arrive and board a vessel not accompanied by the owner.
13.HOLD HARMLESSWinke's Boat Storage, Inc. & Landing does not carry insurance covering the property of the tenant. Winke's Boat Storage, Inc. & Landing will not be responsible for any injuries or property damage resulting or caused by the use of the dock or harbor facilities. Tenant releases and discharges Winke's Boat Storage, Inc. & Landing from any and all liability from loss, injury (including death), or damages to persons or property sustained while in or at the facilities of Winke's Boat Storage, Inc. & Landing, including fire, theft, vandalism, and Acts of God.
14.INSURANCE Owners are required to fully insure their boat against damage and theft, and for liability.
15.MARITIME LIENWinke's Boat Storage, Inc. & Landing shall have a lein against the boat for any loss, damage, or expense to Winke's Boat Storage, Inc. & Landing or its property occasioned by; misuse or use of the boat, dockage, storage, and other charges accrued and therafter accruing, plus interest and attorneys fees. Such lien shall extend to the boat wherever located, and Winke's Boat Storage, Inc. & Landing shall be intitled to possession of the boat to enforce its lien and other rights.
16.OTHER VESSEL Dockage covers the mooring of one (1) watercraft ONLY. Small watercraft shall not be moored for prolonged periods, alongside the primary vessel, at the dock, or on the forward bulkhead. ALL secondary watercraft must be "registered" with the main office. Secondary watercraft, without their own dockage arrangements, must be removed from the water when not in use. Secondary watercraft that will be in the water for a prolonged period of time MUST HAVE a signed dockage contract on file at the main office, prior to occupying a dock. Storage of ANY watercraft in the Marina area, without prior approval, is not allowed. "Short-term and "long-term" storage is available at the boat storage location only!
17.PARKING Only (1) one vehicle is allowed per dock, no RV’s. Secondary vehicles MUST be parked in the parking lot - there are NO exceptions. Boat trailers, PWC’s, etc. are prohibited. Storage, both short and long term can be arranged at the main office located at the storage facility - Thank you.
18.QUIET TIME Quiet time is to be observed from 11:00 P.M. until 7:00 A.M.. It is the responsibility of the charter captains to maintain quiet time in regards to their customers, parents in regards to their children, and for all dockers in regards to their guests --- Thank you!
19. REFUNDS Deposits are non-refundable.
20.RESPONSIBILITIES The boat owner must maintain their dockage space and adjacent area in a neat and clean manner. Utilities (water & electric) shall be obtained by proper connection at the shore. Direct connection to any service is not permitted. Dock boxes shall be kept in good condition and are subject to Management review. No refrigerators or freezers or the like on the shore are permitted.
21.RV’s OHIO REVISED CODE, SECTION 3733.03 prohibits the use of RV’s in Marina areas. No RV’s of any type (including pick-up trucks with bed-campers) will be permitted past the area of the hoist, other than for the express purpose of picking up & the dropping off of people or material(s), and must only be parked in the parking lot area.
22.SPEED Speed limit on ALL Marina roads is 10 MPH. Absolutely NO WAKE in the dockage area(s) - EVERYONE is responsible for damage caused by their wake.
23.SWIMMING State law prohibits swimming in the dock area(s).
24.TREES The trees in the marina are in place for everyone's enjoyment - they are not intended for use as jungle gyms, cloths lines holder, pet anchors, etc. - please report any damage immediately!
25.TV ANTENNAS TV antennas will be permitted only with prior approval (of type and intended installation) of Management.
26. WASTE DISPOSAL All wastes (excluding oil, filters, sewage, etc.) are to be placed by the dockers in the dumpster(s) provided. Fish waste MUST BE double bagged (PLASTIC ONLY). No waste , or stones are to thrown in the water. Oil & related items are to be disposed of in the special dump station provided and so marked. A pump out station is provided at the Gas Dock, and a Port-a-Potty dump station is provided both at the Gas Dock and near the restrooms, for use in the "disposal" of on board "waste". For used BATTERY disposal, please contact the main office. FEDERAL LAW CAN ASSESS A FINE OF NOT LESS THAN $500.
27.WATER USAGE City water (potable) is provided at all taps in the Marina & Campground (unless otherwise marked). While provided for the convenience of the customer, Management reserves the right to restrict use of water if and when abuse occur. Management reserves the right to charge $25 for excessive water usage, after an initial warning has been issued. Every effort will be made to supply water during the rental season, May 1st through November 1st, barring supply and weather difficulties.
28.WORK ON BOAT The vessel’s owner may work on said vessel in the Marina as long as such work does not interfere with the boaters in the Marina, or the operations of the Marina and the staff. The main office should be notified prior to the start of the work. Proof of proper insurance and an understanding of environmental safeguards and practices are also require. If the boat owner wishes to have someone other than themselves or a member of the Marina staff work on said boat in the Marina, prior approval must be obtained from the main office of WINKE’S BOAT STORAGE, INC. & LANDING, no less than 48 hours in advance of the work being performed. Approval will be granted, on a case by case basis, only after the outside "contractor" provides to the main office evidence of a "Standard Certificate of Workman’s Compensation" and "Liability Insurance", in the amount of at least $ 1 million coverage, naming WINKE’S BOAT STORAGE, INC. & LANDING as "Loss Payee". Management reserves the right to refuse entry to the Marina or Boat Storage facility to any "contractor", and reserves the right to remove any contractor found "conducting business" without authorization.
29. HOSE BIBS As mandated by state law, hoses must be disconnected from hose bibs when the boater is away from his dock.
